I assist the client in arriving at an amicable settlement. A good settlement is – at the risk of sounding trivial – when both parties can live with the result in a decent and dignified manner. That is when I have involved both the business-related, financial and tactical, but also, especially, the human considerations. In this respect, I am not only thinking about the considerations for the dismissed employee.
There can be just as great human considerations to be taken by the senior management, the mid-level management or the individual manager who is about to carry out a difficult decision if it involves a dismissal. A wise colleague once told me that “it is all a question of emotions”, and this is actually correct. At least most of the time.
In any circumstances, my experience has taught me that you can come a long way by maintaining human respect and understanding for all the parties of the case. The fact that it is obviously also a pleasure to reach a good settlement in the classic sense does not exclude the former.
I have brought cases before the court for almost 30 years. I will do it if it is necessary. However, in principle, I specifically target the good agreements. Of course, I always do this in respect of the right solution in both the legal and business-related sense.
The close cooperation with the client is vital to create the best results. My assistance is largely based on understanding the person with whom I am face-to-face and the situation that my client is in. The client is in my thoughts – also when the active assistance does not take place.
